What Makes a State Gun Friendly

Gun law comparisons get complicated fast. In practice, five factors separate the states that respect gun owners from the states that regulate them.

1. Permitless (constitutional) carry

Can a law-abiding adult carry a handgun for self-defense without first asking the government for a permit? As of 2026, 29 states say yes. This is the single clearest signal of a state's attitude toward the Second Amendment.

2. State preemption

Strong preemption laws stop cities and counties from passing their own patchwork of gun ordinances. Without it, you can be legal in one town and a criminal three miles down the road. Texas, Florida, Arizona, and most constitutional carry states have firm preemption.

3. Self-defense law

"Stand your ground" and strong castle doctrine mean you have no duty to retreat from a violent attacker in your home, vehicle, or anywhere you lawfully are. Roughly 30 states have some form of stand-your-ground protection, mostly in the South, Mountain West, and Plains.

4. No registries, no waiting periods, no "assault weapon" bans

The most gun friendly states have no firearm registration, no waiting period on purchases, no magazine capacity limits, and no bans on commonly owned rifles. The states people are leaving — California, New York, New Jersey, Illinois, Massachusetts — have all of the above.

5. Culture

Laws follow culture. In a gun friendly state, your neighbors hunt, the sheriff is an ally, ranges are plentiful, and nobody flinches when they find out you carry. That shows up in everything from school policy to how a deputy treats you at a traffic stop.

Several states — including Texas, Idaho, Wyoming, Montana, Missouri, and Tennessee — have passed laws declaring the state a Second Amendment sanctuary or limiting state cooperation with federal gun restrictions.

How many states have constitutional carry in 2026?

Does constitutional carry mean I never need a permit?
